Official Contest Rules and Procedures

This webpage describes the official rules (“Official Rules”) of the Atlantic Cape Community College Mascot Design Contest organized by the Athletics and Marketing Departments at Atlantic Cape Community College (“Atlantic Cape”), (the “Contest”). 

Atlantic Cape will be keeping the team name of “Buccaneers” along with the red and blue school colors. All entries will have to meet these parameters.

The purpose of this contest is to design a mascot that symbolizes the College, and its community, geography and values to foster Atlantic Cape Community College spirit and pride.

Information on how to enter and about the prizes is part of these Official Rules. To the extent of any inconsistency, these Official Rules prevail.

  • “Entry” means a design created by the Entrant for the Contest.
  • “Entrant” means the individual that offers the Entry under the terms of the Contest.

  1. The Contest is open to individuals who are students, alumni, staff, faculty, or administrators at Atlantic Cape Community College. The College will not accept submissions from the general public.  
  2. Entrants must be 18 years of age and able to enter into a contract with Atlantic Cape as required below.

  1. Submissions are due no later than October 17, 2021 at 11:59 p.m.
  2. Entries must follow the contest Design, Name and Additional Guidelines.
  3. Entrants may submit only ONE (1) mascot design and only ONE (1) name.
  4. Each entry should include the following: 1) signed entry form, 2) artwork/worded concept.
  5. Entries must be submitted via website at atlantic.edu/mascotcontest.
  6. Any submissions that are intellectual property of another company or sports entity will automatically be disqualified.

  1. Mascot artwork/design should be original work only. Clip art images/ illustrations are not permitted.
  2. Mascot concepts should provide the name of the mascot, basic design elements and the description of the mascot.
  3. The college will keep the name "Buccaneer" and will not consider alternatives.

  1. Any artwork or concept that is deemed to be plagiarized will be immediately disqualified.
  2. Entrant may NOT post their submissions on public sharing websites, such as; DeviantArt, Tumblr, Facebook, Instagram, etc. until an official winner has been announced on the Atlantic Cape website. Violators will be disqualified from the Contest.
  3. Nudity (implied or actual), drug paraphernalia or other non-­‐family friendly Mascot design and Name submissions will be removed from the competition. Any entries deemed inappropriate by the Mascot Committee will be removed from the competition.
  4. If an entrant is found to be harassing or threatening a fellow entrant, be it online or elsewhere, the entrant responsible for the harassment or threats will be disqualified from the Contest.
  5. All entries submitted will become the property of Atlantic Cape Community College and cannot be pitched or used without express written permission of Atlantic Cape.

  1. Atlantic Cape will organize a Mascot Committee (“MC”) for the Contest to evaluate the submissions by each entrant. Atlantic Cape has the final right of decision on the composition, number of MC members or appointment/ removal of the member of the MC.
  2. The MC will design and/or refine the original design to work within Atlantic Cape marketing standards. The MC will then choose 4 designs for the student body to vote on.
  3. The winning mascot will be determined by popular vote and will be selected as the official mascot for Atlantic Cape, subject to final adoption and approval by the President and college Board of Trustees.
  4. The MC is entitled to review entrant’s qualifications. If an entrant is unqualified for the Contest in accordance with the Official Rules or an entrant has made any false statement in terms of his or her qualifications to participate, the panel has the MC has the right to unilaterally cancel such entrant’s participation qualification at any stage of the Contest.
  5. Atlantic Cape reserves the right to refuse all entries into the contest if the final submissions are not approved by the committee, President or Board of Trustees. In such case, the winner of the student vote will still receive the prize.

The winning entry for the mascot will receive a new iPad Air or cash equivalent.

The winner will be announced on a date to be determined, no later than December 15, 2021.

All entries must concede the following:

  1. I am (a) competent legal adult, 18 years of age or older.
  2. I have read the Official Contest Rules and agree to comply with the rules as stated.
  3. My mascot artwork/design/name complies with the rules and meets the requirements and guidelines stated.
  4. I represent and warrant the following:
    1. I am the sole creator of the mascot artwork/design/name, which I am submitting for the Contest.
    2. My mascot artwork/design/name is a completely original work and has not been copied from some other source.
    3. My mascot artwork/design/name is not obscene or libelous and does not violate or infringe upon the rights of any third party.
    4. I agree that all rights to my mascot artwork/design/name, in part or in whole will be the property of Atlantic Cape Community College.
  5. If my mascot artwork/design/name is selected as a winning entry, in whole or in part, I understand and agree that the College may register it for any trademark, service mark, or copyright purposes (at the College’s sole expense, and the College will solely own such registration.)
  6. I give the College permission to publicize or make known my name and photograph for promotional purposes, without compensation, in connection with the contest and my mascot artwork/design/name.
  7. I understand that I will not receive any money, payment, royalties or compensation of any kind from the College for my mascot artwork/design/name or for all the rights to the mascot artwork/design/name unless my mascot artwork/design/name is selected by the College as the winning entry. If my mascot artwork/design/name is selected as the winning entry, I understand that I will be eligible to receive a contest prize.
  8. If my mascot artwork/design/name is selected as a winning entry, I agree to complete, sign, and execute any other documents reasonably necessary or reasonably requested by the College.
  9. I understand that the Contest may be terminated by the College at its discretion.
  10. I understand that my mascot artwork/design/name may be disqualified by the College pursuant to the Contest Rules and Procedures and the Design, Name and Additional Guidelines.
  11. I agree to indemnify and hold the College harmless against any claim demand, fine, penalty, judgment, loss, expense or liability that may be made against or incurred by the College by reason of the failure or falsity of any of the representations and warranties made in section 5 above, including, but not limited to, all costs, expenses, and legal fees.
  12. I understand and agree that if any one portion of this Agreement is found to be unforeseeable or prohibitive, the remainder of the Agreement shall remain in full force and effect.
  13. I understand and agree that this Agreement shall be binding on the successors, heirs, assigns, and representatives of the parties.
  14. I understand and agree that this Agreement shall be interpreted according to the laws of the State of New Jersey.
